As far as I know, you can safely distribute MPEG encoder/decoder source code. However, as soon as you go to binaries (think about RPMs, debs), you owe a fee to the MPEG foundation. Basically, putting mpeg2enc in the mjpegtools binaries is not allowed. That's why distributions like suse exclude mpeg2enc from the mjpegtools RPMs and why debian doesn't include us as all (we're marked as *non-free* there...) I don't really care, but since you don't wanna do anything illegal, it's something to watch out for ;-). The MPEG foundation owns all rights for MPEG...
