Its not actually clear that the software side is in the US even (ie loading an S3TC texture onto the card is quite different to building a card supporting it). In the EU software patents are currently invalid although a combination of the US goverment through its 51st state outlet (the UK), the BSA and it appears IBM are trying to break EU patent law
