The hardware side may be. Its not actually clear that the software side
is in the US even (ie loading an S3TC texture onto the card is quite
different to building a card supporting it). In the EU software patents
are currently invalid although a combination of the US goverment through
its 51st state outlet (the UK), the BSA and it appears IBM are trying
to break EU patent law
